1. Introduction 1.1. These terms and conditions (‘Terms’) apply to the sale and supply of goods and services by SheeWater Home Ltd (‘we’, ‘us’ or ‘our’), a company registered in England and Wales under company number 4417208, having its registered office at Unit 6, Newton Way, Boongate, Peterborough, PE1 5PJ to you (the ‘Customer’ or ‘you’). 1.2. By placing an order for any goods or services from us in our showroom, you agree to be bound by these Terms. 2.Ordering and Contract Formation 2.1. Our showroom displays and other promotional materials are an invitation to treat, not an offer to supply goods or services. 2.2. When you place an order in our showroom, this constitutes an offer to buy from us. We may accept or decline your order for any reason. A contract is formed when we confirm acceptance of your order in writing. 2.3. Our designs are for illustrational purposes only and do not form a part of our contract, we will provide you with an itemised list of products that forms your sales agreement. 2.4. When placing your order, we cannot accept responsibility for quantities, all quantities are our advised amounts and please seek professional assistance to ensure these are correct. 2.5. All orders placed are bespoke to your order and therefore we are unable to accept returns or offer refunds on any unused or unwanted goods. 3.Prices and Payment 3.1. The prices of our goods and services are as quoted in our showroom and/or promotional materials at the time you place your order. 3.2. Prices may change at any time, but changes will not affect any order for which we have already sent you a written confirmation. 3.3. Payment for all goods and services must be made at the time of placing the order by an accepted credit or debit card. 4.Delivery, Installation, and Risk 4.1. We will endeavour to deliver the goods and provide the services within the agreed time. However, any dates quoted for delivery are approximate only. 4.2. The risk in the goods will pass to you upon delivery. If we are also installing the goods, risk passes upon completion of installation. 5.Warranties, Returns and Refunds 5.1. We warrant that on delivery, the goods will be free from material defects. The warranty period may vary depending on the specific goods ordered, due to the nature of using multiple suppliers. The exact warranty period will be confirmed at the time of purchase. 5.2. If you inform us within the applicable warranty period that some or all of the goods do not comply with the warranty, we will, at our option, replace or repair the defective goods, or refund the price of the defective goods in full. 5.3. We will not be liable for the goods’ failure to comply with the warranty if you make any further use of such goods after giving notice to us. 5.4. As goods are ordered in, they cannot be returned or may be subject to restocking fees. Tiles are non-refundable. 6.Limitation of Liability 6.1. Except in respect of death or personal injury caused by our negligence, we shall not be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the supply of the goods and services. 7.General 7.1. No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing. 7.2. These Terms and any contract between us are governed by English law. Any dispute arising from, or related to, these Terms or any contract between us shall be subject to the exclusive jurisdiction of the courts of England and Wales.
